FEATURES OF THE CONSTITUTION (1957)

At the state level, the Constitutional Head rests with the King or Yang Di-Pertua Negeri. Each state has a State Legislative Assembly with members elected through elections for a period of 5 years headed by the Menteri Besar or Chief Minister. The Chief Executive of the State Government rests with the Yang Di-Pertua Negeri according to their respective constitutions.

In Peninsular Malaysia, this Executive Power is exercised by the State Executive Council (Exco) in the name of the King or Yang Di-Pertua Negeri. In Sarawak, the body is called the Supreme Council while in Sabah it is known as the Cabinet, which has the form of a cabinet at the Federal level. These bodies are the organization of land formation, mortgages, leases and charges on land, ismen and other rights and interests in land, taking land by force, on the rates and valuation of land and local government; and Clauses (1) (b) and (3) shall not apply to any law on any of those matters.

Parliament's Powers Expand Legislative Powers for the States.

(1) It is hereby provided that the power of Parliament to make laws with respect to any matter mentioned in the Federal List shall include the power to permit the State Legislatures or any of them to make laws with respect to all or any of those matters subject to such conditions or restrictions (if any) as Parliament may impose.

(2) Notwithstanding the provisions of Article 75, a state law made in pursuance of the power conferred by an Act of Parliament as referred to in Clause (1) may, if and to the extent provided by that Act, amend or repeal (in relation to the State concerned) any federal law passed before that Act.

(3) Where the State Legislature is for the time being authorized by an Act of Parliament of the State to make laws with respect to any matter, that matter shall, for the purposes of Articles 79, 80, and 82, be deemed in relation to the State concerned to be a matter mentioned in the Concurrent List.
